Terms of Service
Last updated November 1, 2026
These Terms of Service ("Terms") are an agreement between you and Premier Marketing Group International Inc., through its Vantage Technologies division ("MyDigiCards", "we", "us"). They cover the MyDigiCards website at mydigicards.io, the card builder, the public cards you publish, DigiSnap and every other part of the service (together, the "Service").
The short version: you pay for a plan before you can publish. You own your cards and the leads they collect, and you are responsible for collecting them lawfully. We host and process that data for you, keep it secure, and never sell it. Don't use MyDigiCards to impersonate anyone, spam people or break the law. Florida law applies.
By creating an account, buying a plan or using the Service, you agree to these Terms, our Privacy Policy, our Acceptable Use Policy, our SMS & Messaging Terms and, if your cards collect information from other people, our Data Processing Terms. If you agree on behalf of a business, you confirm you are allowed to bind that business, and "you" means the business.
1. Who can use MyDigiCards and your account
- You must be at least 18 years old and able to form a binding contract, or be 13 to 17 with a parent or legal guardian's consent as described in "Members under 18" below. The Service is for business, professional and student use.
- Give accurate sign-up and billing details and keep them up to date. Your account email is where we send sign-in links, receipts and important notices.
- Keep your password private. You are responsible for everything done through your account. Tell us right away at legal@mydigicards.io if you think someone else has accessed it.
- One person or business per account. You may not sell, transfer or share an account except through the agency features described in section 6.
2. Plans, payment and renewal
- Pay first. There is no free plan. You choose a plan and pay before your cards can be published. Current plans and prices are shown on our pricing section and at checkout.
- Who processes payments. Payments are taken through the merchant processing service of Premier Vantage CRM. We do not store full card numbers on MyDigiCards; the payment processor handles them under its own security standards (PCI DSS).
- Plan term and renewal. Plans are billed in advance for the term shown at checkout (usually one year). Unless checkout says otherwise, your plan renews automatically for the same term at the then-current price, and we will email you a reminder before an annual renewal. You can cancel at any time before the renewal date to stop the next charge; your plan stays active until the end of the term you paid for.
- Refunds. Fees are non-refundable except where the law requires a refund or we say otherwise in writing.
- Upgrades and downgrades. Moving to a bigger plan takes effect when the payment for it is received. If you move to a plan with fewer cards, you choose which cards stay published.
- Price changes. We will give you at least 30 days' notice by email before a price change applies to your next renewal.
- Taxes. Prices do not include taxes unless stated. You pay any sales, use or similar taxes that apply.
- Missed payments. If a payment fails or is reversed, we may take your cards offline after telling you and giving you a reasonable chance to pay. Your data is kept while we sort it out (see section 12).
3. Your cards and your content
You keep ownership of everything you put on MyDigiCards: your name, photos, logos, text, links, files and the leads your cards collect ("Your Content").
You give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display, format and transmit Your Content only as needed to run the Service for you, for example to show your published card to the people you share it with, to make QR codes and contact files, and to keep backups. This licence ends when Your Content is deleted from the Service, except for copies in backups until they expire.
A published card is public: anyone with the link, QR code or NFC tag can see it, save it and share it. Do not put anything on a card you would not want made public.
You promise that you have the rights to Your Content, that it is accurate, and that it follows these Terms and the Acceptable Use Policy. Templates come with sample text, photos and testimonials: replace them with your own before you publish, and never present sample testimonials or reviews as real.
4. Leads and the people who use your cards
Your cards can collect information from the people who view them ("Visitors"): names, phone numbers, emails, notes, selfies through DigiSnap, booking requests and survey answers ("Lead Data").
- For Lead Data, you are the business in control (the "controller" or "business") and MyDigiCards processes it for you as your service provider (the "processor"). Our Data Processing Terms form part of these Terms.
- You are responsible for having a lawful reason to collect and use Lead Data, for telling Visitors how you will use it, and for getting any consent the law requires, including before you call, text or email them (for example under the TCPA, the Florida Telephone Solicitation Act, CAN-SPAM and state privacy laws).
- Every MyDigiCards form shows Visitors a short notice that they are sharing their details with you and links to our Privacy Policy. DigiSnap asks for separate consent before a selfie is shared. Do not remove or work around these notices.
- Use Lead Data only to follow up with the people who gave it to you. Do not sell it or add it to unrelated lists.
5. Acceptable use
You must follow our Acceptable Use Policy. In short: no impersonation, no illegal or harmful content, no spam, no harvesting of other people's data, and no attempts to break, overload or get around the security of the Service. We may remove content or suspend cards that break it (see section 12).
6. Members under 18
Draft for counsel review: this section describes how the Service treats members under 18 today. It is not final and is being reviewed by our lawyers.
- Age: we rely on the date of birth members give us when they sign up.
- Under 13: people under 13 may not create an account. Sign-up asks for a date of birth and refuses anyone under 13; nothing is stored for them. Card owners must not use their cards to collect information from children under 13. If you believe a child under 13 has given us information, email legal@mydigicards.io and we will delete it.
- 13 to 17: a member aged 13 to 17 needs a parent or legal guardian's consent. We email the parent or guardian a private approval link (it is never shown to the member). Until they approve, the member's cards cannot go online. The parent or guardian's email cannot be the member's own. If the member names a different parent or guardian later, the earlier approval ends and the cards go offline until the new parent or guardian approves.
- Safety settings until 18: a minor's card is not listed in our directory or offered to search engines; phone numbers and personal email addresses are hidden from the public card (only a contact email the parent or guardian approves, or a verified school email, can show); visitors are never asked for a phone number or a photo on a minor's card; and in-person photo capture (DigiSnap) is off. These settings lift automatically once the member turns 18.
- Recruiting listing (16 and older): a parent or guardian may allow a minor's card to be listed in our recruiting search by sport, position, graduation year and state. The member chooses whether to list a card. Members are responsible for following the recruiting rules that apply to them and their school.
- Withdrawing consent: a parent or guardian can change their choices or withdraw consent at any time with the same link; the member's cards go offline straight away.
By approving, a parent or guardian agrees to these Terms on behalf of the member and is responsible for the member's use of the Service until they turn 18. Student plans require a verified school email, re-verified once a year.
7. Agencies, resellers and sub-accounts
Some accounts ("Agencies") can create and manage accounts for their own customers ("Sub-accounts"). If you are an Agency:
- You confirm you have your customer's permission to create and manage their Sub-account, and you are responsible for making sure your customers follow these Terms.
- You can see and change the cards, settings and Lead Data in your Sub-accounts. Tell your customers this.
- Unless we agree otherwise in writing, you handle billing and first-line support for your Sub-accounts, and you may not make promises about MyDigiCards that go beyond these Terms.
- If your Agency account ends, we may contact your Sub-account customers directly so they can keep their cards and data.
If your account is managed by an Agency, your Agency can see your cards and leads, and your arrangement with the Agency (including what you pay them) is between you and them.
8. Features that need setup, and Beta features
Some features work only once they are set up for your account (for example text messaging, CRM sync and wallet passes need a connection or credentials in place). We do not promise a date for a feature that is not yet available on your account. Features marked Beta (for example the paper-card scanner) may change or stop and are provided as they are.
Booking tiles send a request to you; they do not reserve a time until you confirm it with the Visitor.
9. Card links, QR codes and NFC tags
- Your card link (for example mydigicards.io/your-name) is yours to use while your account is active, but it is not your property. Some words are reserved for the Service. We may change or reclaim a link that infringes someone's rights, impersonates someone, or belongs to an account that has ended.
- QR codes and NFC tags you print point to mydigicards.io. If your card is unpublished or your account ends, those printed codes will stop showing your card. We are not responsible for the cost of reprinting.
10. Third-party services and embeds
The Service relies on other providers (listed in our Privacy Policy), and your cards can link to or embed other sites and services (videos, maps, social profiles, custom code). Those services have their own terms and privacy practices. We are not responsible for them, and if you embed custom code or third-party content on a card you are responsible for what it does, including any cookies it sets.
11. Our property and your feedback
The Service, including the builder, templates, designs, software and the MyDigiCards name and logo, belongs to us or our licensors. Your plan gives you a limited, non-transferable right to use them to make and share your own cards while your account is active. You may not copy, resell, reverse-engineer or build a competing product from the Service, or scrape it.
If you send us ideas or feedback, we may use them without owing you anything.
12. Privacy and security
Our Privacy Policy explains how we handle personal information. We use reasonable technical and organisational measures to protect the Service and Your Content, but no system is perfectly secure. Keep your own copies of anything important; you can export your leads as a CSV file at any time.
13. Suspension, cancellation and termination
- You can cancel your plan at any time (see section 2) and ask us to delete your account by emailing legal@mydigicards.io.
- We may suspend or take down a card or account, with notice where reasonable, if you break these Terms or the Acceptable Use Policy, if payment fails, if the law requires it, or if your use puts other people or the Service at risk. Where the problem can be fixed, we will give you a chance to fix it.
- When an account ends, its cards go offline. For 30 days afterwards you can ask us for an export of your cards and leads. After that we delete your data as described in our Privacy Policy.
- Sections that by their nature should survive (payment owed, ownership, disclaimers, limits of liability, indemnity and governing law) survive the end of these Terms.
14. Disclaimers
We work hard to keep MyDigiCards running well, but the Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Service will be uninterrupted or error-free, or that your cards will produce any particular number of leads or sales.
15. Limits of liability
To the fullest extent the law allows:
- Neither side is liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, even if told they were possible.
- Our total liability for all claims about the Service is limited to the amount you paid us for the Service in the 12 months before the event that led to the claim.
- These limits do not apply to your payment obligations, your indemnity under section 15, or liability that cannot be limited by law.
16. Indemnity
You will defend and indemnify Premier Marketing Group International Inc. and its officers, employees and agents against claims, losses and costs (including reasonable legal fees) arising from Your Content, the way you collect or use Lead Data (including calls, texts and emails you send), or your breach of these Terms or the law.
17. Governing law and disputes
These Terms are governed by the laws of the State of Florida and applicable US federal law, without regard to conflict-of-law rules. Before filing a claim, please email us at legal@mydigicards.io so we can try to resolve it informally within 30 days.
Any claim that is not resolved informally must be brought in the state or federal courts located in or serving Orange County, Florida, and both sides agree to those courts' jurisdiction. Either side may bring an eligible claim in small-claims court instead.
18. Changes to these Terms
We may update these Terms as the Service changes or the law requires. We will post the new version here with a new "Last updated" date and, for material changes, email account owners at least 30 days before they take effect. If you keep using the Service after that, the new Terms apply. If you don't agree, you can cancel before they take effect.
19. General
- These Terms and the policies they link to are the whole agreement between us about the Service.
- If any part is found unenforceable, the rest stays in effect. Not enforcing a right is not a waiver of it.
- You may not transfer these Terms without our written consent. We may transfer them as part of a merger, acquisition or sale of assets, or to another company in our group.
- Neither side is responsible for delays caused by events outside its reasonable control.
- We send notices to your account email. You can send notices to legal@mydigicards.io.
